Application refers to KeepTrackMed, the software program provided by the Company.

Company (referred to as either "the Company", "We", "Us" or "Our" in these Terms and Conditions) refers to Keep Track Solutions Ltd, a company registered in Scotland under company number SC742035 with its registered office at Clyde Offices, 2nd Floor, 48 West George Street, Glasgow, Scotland, G2 1BP. For the purpose of the Data Protection Legislation, the Company is the Data Controller.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Data Controller, for the purposes of the Data Protection Legislation (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

Data Protection Legislation is the UK GDPR, the Data Protection Act 2018 and the Privacy and Electronic Communications (EC Directives) Regulations 2023.

Device means any device that can access the Service such as a computer, a mobile phone or a digital tablet.

Personal Data is any information that relates to an identified or identifiable individual. For the purposes of the Data Protection Legislation, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.

Service refers to the Application or the Website or both.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used. For the purpose of the Data Protection Legislation, Service Providers are considered Data Processors.

UK GDPR refers to the EU law retained version of the General Data Protection Regulation ((EU) (2016/679).

Website refers to KeepTrackMed, accessible from www.keeptrackmed.com

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under the Data Protection Legislation, You can be referred to as the Data Subject or as the User as You are the individual using the Service.

Collecting and Using Your Personal Data

Types of Data Collected

Identity Data

While using Our Service, You will be required to provide Us with a personal identifier, such as Your first name or Your initials, and We strongly advise against using any personally identifiable information, such as Your date of birth or national insurance number. We do not collect any other Identity Data about You through use of the Service. If You choose to input Your full name or other identifying data into the Service, this will be considered Identity Data. In cases where a surname is entered into the Service, we reserve the right to remove the surname and retain only the first name for privacy purposes. The Service has a feature whereby You can upload photos or files, which may include Your image of the image of those in Your family or group of users. These images are considered Identity Data. We do not collect any other Identity Data about You through use of the Service.

Contact Data

We will require that You provide Us with Contact Data so that We can provide You with the Service, contact You about Your Account, or deliver Your subscription. You may also provide Contact Data if You contact Us in respect of the Service.

Contact Data includes phone numbers and email addresses.

Financial Data

As Our Service is available via a paid subscription, You will be required to provide Your Financial Data to the Service Provider responsible for collecting and processing payments.

Financial Data includes bank account and payment card details.

Please note that We do not ever have access to Your Financial Data – this is processed by the Service Provider responsible for collecting and processing payments.

Profile Data

This is information relating to Your Account with the Company, and includes Your username and password, purchases or orders made by You, Your interests, preferences, feedback, and survey responses. 

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device.

Technical Data

Technical Data is collected automatically when using the Service.

Technical Data may include internet protocol (IP) address, Your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the Devices You use to access the Service.

Marketing and Communication Data

Marketing and Communication Data includes Your preferences in receiving marketing from us and Our third parties and Your communication preferences.

You may receive marketing communications from Us if You have requested information from us or purchased goods or services from Us and You have not opted out of receiving that marketing. We will obtain Your express opt-in consent before We share Your Personal Data with any third party for marketing purposes.

You can ask Us or third parties to stop sending You marketing messages at any time by following the opt-out links on any marketing message sent to You or by contacting Us at any time.

Where You opt out of receiving these marketing messages, this will not apply to Personal Data provided to Us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

Aggregated Data such as statistical or demographic data for any purpose, is not considered Personal Data in law as this data will not directly or indirectly reveal Your identity to Us. We may aggregate Your Usage Data to calculate the percentage of users accessing a specific Service feature.

Health Data such as information directly inputted into the Service or represented in photos or files uploaded to the Service relating to Yourself or relating to those in Your family or group of users, relating to health, including without limitation information on medical conditions, prescriptions, medications, medical tests, vaccinations and symptoms. Health Data is considered a special category of Personal Data and is treated differently to other types of Personal Data, such that We must have your express consent to process it. By uploading the Health Data to the Service, whether in text or photo or other format, You are giving Your express consent to the processing of that Health Data and accordingly. We rely on consent and the performance of a contract when we process that Health Data. Please note, however, that We have no access to, nor can We see any Health Data of any kind that it uploaded to the Service, although it is still stored on our servers.

Besides Health Data, We do not collect any other Special Categories of Personal Data about You (this includes details about Your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, and genetic and biometric data). It is however possible that You will upload to the Service Personal Data relating to health. We also do not collect any information about criminal convictions and offences.

How is Your Personal Data Collected

We may use different methods to collect data from and about You including through:

Direct interactions. You may give us Your Identity and Contact by filling in forms, by corresponding or engaging with us by post, phone, email, social media or otherwise.

Your use of the Service. You may give us Your Identity and Contact and Health Data, or that of those in Your family or group of users, through use of the Service.

Automated technologies or interactions. As You interact with the Service, We will automatically collect Technical Data about Your equipment, browsing actions and patterns. We collect this Personal Data by using cookies, server logs and other similar technologies. We may also receive Technical Data about You if You visit other websites employing Our cookies. Third parties or publicly available sources. We may receive Personal Data about You from various third parties and public sources, such as Google, Companies House, or the electoral register.

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

We use this information to provide features of Our Service, to improve and customise Our Service. The information may be uploaded to the Company’s servers and/or a Service Provider’s server or it may be simply stored on Your Device.

To provide You with news, special offers and general information about other goods, services and events which We offer that are similar to those that You have already purchased or enquired about unless You have opted not to receive such information. This includes Identity, Contact, Profile, Usage and Marketing and Communications Data. The lawful basis We rely on is legitimate interests.

To manage Your requests: To attend and manage Your requests to Us. This includes Identity, Contact and Profile Data. The lawful bases We rely on are contract and legitimate interests.

For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganisation, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about Our Service users is among the assets transferred.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy and Cookie Policy. We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (for example, if We are required to retain Your Personal Data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies. Your Rights under the Data Protection Legislation

The Company undertakes to respect the confidentiality of Your Personal Data and to guarantee You can exercise Your rights.

  • Request the transfer of Your Personal Data. We will provide to You, or to a third-party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to perform a contract with You.

  • Withdraw Your consent. You have the right to withdraw Your consent on using Your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Service.
     

Exercising Your Rights

You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us. Please note that We may ask You to verify Your identity before responding to such requests. If You make a request, We will try Our best to respond to You as soon as possible. You will not have to pay a fee to access Your Personal Data (or to exercise any of the other rights), but We can charge a reasonable fee if Your request is clearly unfounded, repetitive, or excessive, or We can refuse to comply in these circumstances.

 

We try to respond to all legitimate requests within one month, but it could take longer than a month if Your request is particularly complex or You have made a number of requests. In this case, We will notify You and keep You updated.

  • Right of deletion:

    • You have the right to request that We delete Your personal information, subject to certain exceptions

  • If You wish to delete Your Personal Data that you have inputted into the Service, You can delete in by accessing the settings in the Subscription area of the Service. If You wish for Us to delete Your Personal Data that We hold about You, please contact Us at support@keeptrackmed.com  Please note that We may require certain information from You in order to verify Your identity before proceeding with Your request.

 

We collect the categories of personal information from You in connection with Your use of Our Service as described above. We will not discriminate against You for exercising any of Your CCPA rights.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13, however a parent or guardian may input Personal Data relating to children under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.
